Introduction These Terms of Service (“Terms”) govern your use of the website, online store, and any related services provided by Rebecca Minniti Art (“we,” “us,” or “our”). By accessing or using our site, purchasing original artwork or prints, or otherwise interacting with our services, you agree to these Terms. If you do not agree, do not use our site or place an order.

  1. Products and Availability

  • We offer original works of art and prints. All product descriptions, images, and pricing are provided to the best of our ability but are subject to change.

  • Availability is not guaranteed. If an item is out of stock or unavailable after you place an order, we will notify you and provide options such as cancellation, refund, or a substitute (if available).

  1. Orders and Payment

  • Placing an order constitutes an offer to purchase. Orders are accepted, and contracts are formed, only when we send an order confirmation email or otherwise confirm acceptance.

  • We accept payment methods displayed at checkout. Payment must be received in full before an item ships.

  • Prices do not include taxes, shipping, or handling unless explicitly stated. You are responsible for any applicable taxes, duties, or fees imposed by your local government.

  1. Shipping and Delivery

  • Shipping times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, or other third parties.

  • Risk of loss for items purchased passes to you upon delivery to the carrier. For domestic and international shipping, please verify your shipping address carefully; we are not responsible for items shipped to an incorrect address provided by you.

  • International buyers are responsible for customs duties and import taxes.

  1. Returns, Refunds, and Exchanges

  • Because original artworks are unique, returns are generally not accepted for original pieces unless damaged or misrepresented. Prints may be eligible for return within 14 days of delivery if they are unused and in original condition—see our Returns Policy for details.

  • To request a return, refund, or exchange, contact us within the timeframe specified for that product and provide photos and a description of the issue.

  • Refunds will be issued to the original payment method after inspection and approval. Shipping costs are non-refundable, except in cases where we shipped the wrong or defective item.

  1. Cancellations

  • Orders may be cancelled prior to shipment. Once an item has shipped, it cannot be cancelled. Contact us immediately if you need to cancel; we will do our best to accommodate but cannot guarantee we can stop shipment.

  1. Intellectual Property

  • All artwork, images, website content, text, designs, and related materials are owned by Rebecca Minniti Art or used with permission and are protected by copyright and other intellectual property laws.

  • Purchasing an original artwork or a print grants you a single, non-transferable right to possess the physical item. Unless we grant a separate written license, you do not acquire copyright, reproduction rights, or any other intellectual property rights to the artwork.

  • You may not reproduce, distribute, publicly display, or create derivative works from our artwork without our prior written consent. For licensing or commission inquiries, contact us.

  1. Commissions

  • Commission terms (price, timeline, deliverables, revisions, and cancellation policy) will be agreed upon in writing for each commission project. A deposit may be required to secure the commission.

  • Deposits are generally non-refundable once significant work has begun. Specific refund and cancellation terms will be provided in the commission agreement.

  1. Pricing Errors

  • In the event of a pricing or typographical error, we reserve the right to refuse or cancel any orders placed for items listed at an incorrect price. If your order is canceled for this reason after payment, we will refund the full amount.

  1. Warranties and Disclaimers

  • Artwork is provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

  • We do not guarantee color accuracy between digital images and the physical artwork or print due to screen display differences, printing variations, and materials.

  1. Limitation of Liability

  • To the maximum extent permitted by law, Rebecca Minniti Art and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our site, purchase of artwork, or any breach of these Terms.

  • Our total liability for direct damages arising from these Terms or your purchase shall not exceed the amount paid by you for the artwork in question.

  1. Privacy

  • We collect and process personal information as described in our Privacy Policy. By using our site and services, you consent to the collection and use of your information in accordance with that policy.
